TERMS & CONDITIONS
PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING YOUR ORDER AND RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE.
1. FORMATION OF THE CONTRACT
1.1 These terms of sale apply to all goods supplied by ADAIR ACOUSTIC, a subsidiary brand of ADAIR ACOUSTIC DESIGN LTD, registered in England and Wales No 3577933 (“ADAIR ACOUSTIC”, “we”, “us”, “our”).

1.3 No contract exists between you and ADAIR ACOUSTIC for the sale of any goods until we have received and accepted your order and we send you confirmation in writing by email to the email address you have given. Once we have done so, there is a binding legal contract between us.
1.4 We may change these terms of sale without notice to you in relation to future sales.
2. DESCRIPTION AND PRICE OF THE GOODS
2.1 Any goods which are non-bespoke or non-personalised are subject to availability, as indicated on the individual product pages of the website.
2.2 In addition to the price, you may be required to pay a delivery charge for the goods.
2.3 All prices are inclusive of 20% VAT but exclude delivery costs, for which we, or our nominated delivery company, will provide you with a quote, and will be added to the total amount. VAT will be refunded on orders delivered to outside of the European Union.
Note: Installation of products is not included and will always need to be quoted separately.
3.1 All payments must be made online by credit card, debit card or Paypal, and you will be responsible for any charges involved in the transaction. If your payment is declined by your bank, your order will not be accepted and we will not be liable for any delay or non-delivery.
3.2 We accept VISA, Mastercard, Switch, Maestro and American Express [AMEX]. All orders will be charged in GBP pounds sterling. To securely receive your payments over the internet we use Barclays EPDQ technology which provides secure online credit card and debit card solutions. Barclays has achieved the highest level of compliance under the Payment Card Industry Data Security Standard [PCI]. They adhere to the most stringent levels of fraud screening, ensuring that our customer details remain secure throughout the transaction process.
3.3 We accept Payment via bank transfer – goods will only be dispatched after the transfer has been received into our bank. All banking fees and currency exchange fees should be borne by the client. If the goods are special order then the funds have to be received into our bank before we place the order with our supplier.
4.1 The goods you order will only be delivered to the cardholder / PayPal registered shipping address. We can ship internationally, and shipping costs vary. You will be notified of the exact cost of your shipment at checkout or by
4.2 If there is no one at the address given who is competent to accept delivery of the goods, you will be notified of an alternative delivery date or a place to collect the goods.
4.3 You will become the owner of the goods you ordered once we receive full payment, including delivery charges. You will be responsible for risk of loss of or damage to the goods from the time of delivery.
4.4 All orders must be signed for at point of delivery. If your order is returned because no signature was obtained or for any reason such as postal strikes, you will be responsible for all return and re-delivery charges. If someone unauthorised signs for your purchase at the address you have given us, it will not be the responsibility of ADAIR ACOUSTIC.
4.5 Delivery time is subject to product availability, clearance of your payment and delivery location.
4.6 We insure the good to the value of its list price. Where there are multiple packages, a shipping charge may be applied to each individual package, and we will notify you as to the cost of such charges at the same time we inform you of any other charges relating to your order. No consequential losses may be claimed for any delays or courier errors.
4.7 Please note that any duties and taxes incurred in the country of destination are the responsibility of the client.
4.8 Usually deliveries are made within 2 working days if in-stock. If they are not in stock fulfilment will be within 2 weeks and if an item is “made to order” fulfilment will be within 8 weeks.
5. GUARANTEE AND RETURNS
5.1 We take pride in the quality of our products, and our policy is to ensure that all products supplied are delivered in perfect condition.
5.2 Every effort is made to assure accurate impression of our products through the ADAIR ACOUSTIC website. However, some images may not be to scale and the colours shown may vary depending on the individual computers and monitors and their settings. ADAIR ACOUSTIC reserves the right to change product specifications and prices at any time.
5.3 We regret we are unable to offer refunds, and nor are you able to cancel your contract, for any goods ordered from us which are bespoke or personalised.
5.4 We regret that, for heath and safety reasons, in-ear headphones cannot be returned for credit once the packaging seal has been broken.
5.5 If you wish to return goods please adhere the following Returns Policy:
5.5.1 Please Inform us in writing by emailing email@example.com within 7 calendar days from the date you received your goods. You will then receive a confirmation email within 2 working days approving the return if it falls within our terms and conditions. Please pack the relevant item securely and mail it to us, along with proof of purchase, within 14 calendar days of the invoice date to: ADAIR ACOUSTIC, 2nd Floor, 64 Clerkenwell Road, London EC1M 5PX.
5.5.2 Please retain proof of postage as we cannot be held responsible for parcels lost in transit;
5.5.3 All items must be returned in an unused condition and re-sellable condition with all accessories included, and with proof of purchase. We cannot be held responsible for any items returned to us in any other way.
5.6 If all of the above conditions have been met, then we will refund the price of the items within 28 days of your order to the same card used to pay for your purchase. We will send you email confirmation. There will be no refunds for delivery charges.
5.7 If your goods are faulty or incorrect, you must let us know in writing by email to firstname.lastname@example.org . We will be responsible for the cost of returning faulty or incorrect goods to us.
6. ORDER AVAILABILITY AND CANCELLATION
6.1 The website displays product availability. In the event that a product becomes unavailable after order, we will inform you by email.
6.2 If you realize you have made a mistake and want to cancel your order, please contact us as soon as possible on email@example.com or call +44 (0) 7956 236 108. If we have already processed your order, it may not be possible to cancel so please adhere the Returns Policy (5.4).
6.3 We reserve the right to cancel the contract between you and us if:
a] we have insufficient stock to deliver the goods you have ordered and cannot secure a reasonable lead time from our supplier.
Or b] we do not deliver to your area/territory;
Or c] one or more of the items you have ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
6.4 If we do cancel your contract we will notify you by email and will re-credit to your account any sum deducted by us from your credit card as soon as possible, within 28 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

7. DATA PROTECTION
7.1 We will take all reasonable precautions to keep the details of your order and payment secure, but unless we are negligent, we will not be liable for unauthorised access to information supplied by you.
7.2 We will use the information you provide about yourself for the purpose of fulfilling your order. You can correct any personal details, or ask for your personal details to be deleted, by giving written notice to us at email@example.com.
8. UNFORESEEN EVENTS
8.1 In the event of the normal course of manufacture of the goods or performance being prevented, interrupted, hindered or delayed by any cause whatsoever beyond our control, we shall have the option without incurring liability to you, to defer the date of delivery.
9.1 We shall be entitled to sub-contract the supply of goods and the performance of any services in relation to your goods.
10. INTELLECTUAL PROPERTY
10.1 All worldwide intellectual property including any copyright, registered or unregistered design rights in and relating to the goods including any blueprints, designs, drawings, illustrations, specifications and instructions prepared by us in connection with the order shall vest in us unless set out by express agreement in writing.
11. APPLICABLE LAW
11.1 These terms of sale and the supply of the goods will be subject to English law, and the English courts will have jurisdiction in respect of any dispute arising from the contract.

What personal information may be collected and by what means?
ADAIR ACOUSTIC only collects personal information from our online visitors on a voluntary basis, and when a transaction is processed. ADAIR ACOUSTIC collects this information to the extent deemed reasonably necessary to serve its legitimate business purposes and will maintain appropriate safeguards to ensure the security, integrity and privacy of the information you have provided. Visitors purchasing goods and services through our online store will need to provide a valid credit card number, expiration date and CSC, in addition to their name, billing address, phone number and email address. These details allow us to process your order and to let you know the status of your order.
